Background

On 29 November 2024, the remaining Roe Highway Stages 8 and 9 Primary Regional Road reservation was reclassified under the Metropolitan Region Scheme (MRS) from ‘Primary Regional Road reserve’ to the ‘Urban’ zone and ‘Parks and Recreation’ reservation.

In accordance with section 126(1) of the Planning and Development Act 2005, the City of Cockburn’s Town Planning Scheme No. 3 has been amended to reflect and align to the reclassification described above.

  • ‘Parks and Recreation’ reserve reclassified under the MRS have been similarly identified as such in the City’s TPS 3;
  • ‘Urban’ zone under the MRS however, is identified as ‘No Zone’ under TPS 3.

In acknowledgment of the MRS amendment, the City of Cockburn initiated Scheme Amendment No. 166 to rezone areas now depicted as ‘No Zone’ under TPS 3 and seeks to address this gap in the Local Planning framework. Submissions on Scheme Amendment No. 166 are invited from the community.

About the proposed changes

The purpose of the Scheme Amendment is to provide an appropriate zoning for the areas now depicted as ‘No Zone’ and depict existing roads as ‘local road’ reserves.

Key elements of the Scheme Amendment are detailed below.

  • Introduction of a ‘Development’ zone over most of the affected area, and two ‘Special Control Areas’ (Development Area 46 & 47), inclusive of high-level special provisions to guide the subsequent structure planning of each area.
  • Expansion of the existing ‘Mixed Business’ zone located on the northern side of Rockingham Road, Hamilton Hill, to the west of Leda Street.
  • Expansion of the ‘Residential’ zone and introduction of an R30 density code in Bibra Lake, north of Hope Road.
  • Introduction of ‘Local Road’ reservations on several existing constructed roads.

What will happen next

Following the public advertising period, City Officers will review the submissions and prepare a report to Council inclusive of a recommendation on a final determination.

The proposals (including the Council adopted recommendation) will then be forwarded to the State Government for final determination.

Please note that as the final decision makers, the Minister for Planning, must consider, but are in no-way bound to determine either application in accordance with the City’s recommendation.

Also to note, this Local Planning Scheme Amendment is not a structure plan. A structure plan provides more detail such as where housing or parks are located and key road links. This will happen later and will take time. The structure plan process is typically instigated by submission of a draft proposal by the landowner (or a consultant engaged on their behalf).
