Background

The City of Cockburn is advertising proposed changes to Town Planning Scheme No.3 (TPS3) to implement the State Government’s new requirements for short-term rental accommodation (STRA).

STRA is the practice of renting out a property or part of a property to paying guests for stays of up to three months, usually booked through online platforms (such as Airbnb).

About the Amendment

To align with the new requirements, the following State Government land use definitions are proposed to be included in Town Planning Scheme No. 3:

  • ‘Hosted short-term rental accommodation’ and ‘unhosted short-term rental accommodation’
  • ‘Tourist and visitor accommodation’ replacing other land uses of ‘Bed and breakfast’; ‘Holiday home (standard)’; ‘Holiday home (large)’; ‘Motel’; ‘Lodging house’; and ‘Tourist accommodation’
  • New land uses of ‘Road house’ and ‘Workforce accommodation’ (which are cross-referenced in the above proposed definitions).

What will happen next?

Following the public advertising period, City Officers will review the submissions and prepare a report to Council with a recommendation on a final determination.

The proposal (including the Council adopted recommendation) will then be forwarded to the State Government for final determination.

The Western Australian Planning Commission (WAPC) will review the proposal and Council's advice and make a recommendation on final determination to the Minister for Planning.

Council requires a Schedule of Submissions to be prepared which includes a submitter's name and address. This forms part of a Council Agenda report, which is available for public viewing (published on the City’s website).
