1. Why does this application require a Planning Approval?

    Under the City of Cockburn Town Planning Scheme No.3, a Tavern is classified as an ‘A’ use (Table 1 – Zoning Table) which means that a Planning Approval is required and the City must advertise the application in accordance with Clause 64(3) of the Planning and Development (Local Planning Schemes) Regulations 2015.

    2. How long is the City required to advertise the application?

    In accordance with the Planning and Development (Local Planning Schemes) Regulations 2015, the City is required to advertise the application for 14 days. Given that the City has decided to reduce the paper utilised by avoiding a bulk mail-out, the City has advertised the application for a period of 35 days via the following means:

    • Comment on Cockburn;
    • Signage on site; and
    • Formally notifying via email letter all Strata body contacts within a 100 metre radius of the site. The City has advertised for 35 days in lieu of 14 days to accommodate for the timeframes involved with Strata by-laws (notification of owners and tenants).
