Council resolved at the Ordinary Council Meeting held on 14 April 2022 that Council supports the proposal for the State of Western Australia to transfer their ownership (‘closure’) of the right of way located at Lot 843 Lakefront Ave, Beeliar to Beeliar Property Developments Pty Ltd, on the condition that an easement in gross for public access be granted to the City of Cockburn. Fifty-five (55) submissions were received during the 35-day public consultation period 11 November, 2021 to 5 January, 2022. It became apparent from the submissions received that there was a misunderstanding/misinterpretation from the public in relation to the procedural requirements of the Public Access Way (PAW) ‘closure’ and that residents had not been aware that they would still have continued access to the PAW via the easement arrangement. There was also a misunderstanding that the public consultation process was in relation to the child care centre development approval, and therefore a number of the objections were against the development itself rather than the procedural closure of the PAW.

The City has forwarded to DPLH the Council resolution to support the PAW closure, and DPLH will proceed with formalising the PAW closure and creating an easement to ensure continued public access.
