Proposed Modifications - Scheme Amendment No 130: 'Mixed Use' area of Harvest Lakes Structure Plan

The City is seeking community feedback on proposed modifications to Scheme Amendment 130 which seeks to include zoning information currently shown on the Harvest Lakes Structure Plan into the Town Planning Scheme now that the area has been developed.

The purpose of a Structure Plan is to guide subdivision and development of new areas, and once the roads, reserves, and lots have been created (and houses have been built) the Structure Plan in most cases no longer serves a purpose.

Proposed Scheme Amendment No. 130

For most of Harvest Lakes the zonings shown on the Structure Plan will be the same zones included in the Scheme which is simply an administrative change. However, there are some properties currently identified as ‘Mixed Use – R40’ which require a different approach.

In 2005 when the Structure Plan was adopted the original idea behind this ‘Mixed Use’ area was to provide an opportunity for a mix of land uses such as housing, offices, and commercial uses near the local centre (now the Harvest Lakes Shopping Centre). However, all of this area has now been developed with conventional residential lots.

For this reason, the City had originally proposed to zone these lots ‘Residential R40’. However, during the advertising period concern was raised that the change will restrict possible future uses which were understood to be permissible upon purchase of properties in this area.

This concern is acknowledged, and in response Council are now proposing to zone these properties ‘Mixed Use – R40’ zone, with an ‘Additional Use’ of ‘Single House’ (given that the ‘Mixed Use’ zone under the Scheme does not ordinarily allow for single houses) (adopted for advertising at the 12 September 2019 Meeting).

This proposed zoning would facilitate a range of uses that are generally more aligned to the current ‘Mixed Use’ designation under the Harvest Lakes Structure Plan, and would therefore be similar to the current designation under the Structure Plan.

The purpose of the ‘Mixed Use’ zone under the Scheme is to allow for commercial uses that are compatible with residential development, which is appropriate to the circumstances. The Scheme sets out the range of uses that are permissible under this zone.

Plans and documents are available to view online here or at the City of Cockburn Administration Building, 9 Coleville Crescent, Spearwood during office hours (Monday to Fridays, 8.30am – 4.30pm) up to and including 21 November 2019.
