Scheme Amendment No. 128 – Development Contribution Exemptions

A scheme amendment for the purpose of modifying Clause 5.3.13.3 of the scheme to provide additional exclusions to the development contribution liability clause has now been gazetted.

The existing scheme clauses related to development contributions originated from State Planning Policy 3.6 (SPP3.6) and were written with primarily greenfield development in mind. In practice, the City found the liability clause required amending to align the objectives of the contributions better with the types of development our landowners are undertaking.

Cockburn landowners undertake types of development which inadvertently triggered the development contribution liabilities before they were intended. Amending the scheme has ensured it is clearer which types of development do not warrant payment of a contribution.
