The City of Cockburn is proposing to amend Town Planning Scheme No. 3. This amendment involves adding the zones and reserves detailed in a Structure Plan (Development Area 11) into the City's Town Planning Scheme, as this Structure Plan is no longer needed. The City invites the community to provide feedback on this proposal. 

About the amendment

Structure Plans are important tools for organising how land is divided and developed, especially in new, green-field areas. When a Structure Plan has done its job, its zones and reserves get transferred into the Town Planning Scheme, and the Structure Plan is revoked.



The City of Cockburn is proposing to amend Town Planning Scheme No. 3. This amendment involves adding the zones and reserves detailed in a Structure Plan (Development Area 11) into the City's Town Planning Scheme, as this Structure Plan is no longer needed. The City invites the community to provide feedback on this proposal. 

About the amendment

Structure Plans are important tools for organising how land is divided and developed, especially in new, green-field areas. When a Structure Plan has done its job, its zones and reserves get transferred into the Town Planning Scheme, and the Structure Plan is revoked. This is called structure plan 'rationalisation,' and it helps the City keep control of development in line with what the community expects. 

The City must advertise any proposed amendments which include zonings that don't directly match the approved structure plan.

Scheme Amendment 163 aims at rationalising parts of Development Area 11. Development Area 11 is situated south of Gibbs Road and east of the Kwinana Freeway in Aubin Grove (refer to the map in the Document Library). 

The amendment includes:

  • Rezoning various lots within ‘Development Area 11’ from ‘Development’ to ‘Residential (R20)’, ‘Residential (R40)’, ‘Local Centre’, ‘Mixed Use (R30)’, and/or ‘No Zone’
  • Reclassifying land within ‘Development Area 11’ from the ‘Development’ zone to a ‘Parks and Recreation’ reserve
  • Introducing new 'Restricted Use No. 16' (RU16) and 'Restricted Use No.17' (RU17) into the Scheme
  • Reducing the extent of the 'Development Area 11' (DA11) special control area boundary to match the above changes.

Rationalisation of the balance of DA11 is part of a separate basic scheme amendment which do not require advertising and has been sent directly to the State Government for final approval (refer to ‘Council Initiation – August 2023 OCM Extract Amendment 162’ in the Document Library)

What will happen next

After the submission period, the City will consider the community’s feedback along with planning rules and policies.

The City will suggest an outcome to Council, who will make a recommendation to the Western Australian Planning Commission (WAPC). The WAPC reviews Council’s recommendation and decides on an outcome. The WAPC presents the outcome to the Minister for Planning, who makes the ultimate decision.
