What changes are proposed to Town Planning Scheme no. 3?

    The proposal involves amending Town Planning Scheme No.3 by:

    2. A ‘Showroom’ land use shall be contained only within the existing shopping centre development and shall not exceed a gross lettable area of 1,850m² in aggregate. In the event that the shopping centre is to be demolished, the ‘Showroom’ use will cease to apply.


    2.      Amending the Scheme map to designate ‘AU 20’ over Lot 760 (No.49) Berrigan Drive, South Lake.

    3.      Amending the definition given to ‘Funeral Parlour’ in ‘2. Land Use Definition’ in ‘Part 6 – Terms Referred to in Scheme’ to accord with the Schedule 1, Part 6, Clause 38 of the Planning and Development (Local Planning Schemes) Regulations 2015, as follows:

    Why is the City proposing to update Town Planning Scheme no. 3?

    The proposed amendment has been submitted in recognition of difficulties leasing the existing anchor tenant in the Berrigan Quarter Shopping Centre, which was previously tenanted by an IGA supermarket.

    The amendment will support future development proposals for the shopping centre, by attracting land uses which are not currently permitted within the ‘Local Centre’ zone and supporting ongoing viability of the centre.

    What impact will this change have?

    The amendment will allow the landowner and/or tenants to submit a development application for a ‘Showroom’, ‘Motor Vehicle Wash’ and ‘Funeral Parlour’ land use, following approval and gazettal of the amendment.

    Future development approvals may result in changes to the specific land uses within the centre, and modifications to built form (including the potential for additional built form).

    In recognition of the existing centre’s role for convenience retailing, any ‘Showroom’ uses will be confined to the existing development and limited to a gross lettable area of 1,850m².
